Message from the special administrator Rangelea Appeal Update

There was a hearing on Tuesday 14 May 2024 before the Chief Justice of SA.  This hearing is what they call a directions hearing.  At this hearing there was no discussion about the appeal or the case.  The Chief Justice also needs to wait until the outcome of the appeal is known.   There was however one matter discussed at the hearing.  This is the Adnyamathanha Master Trust was about to end or to vest in legal terms.  It would not have been in any one’s interest for the Trust to come to an end and the Chief justice issued the following orders:

Order

  1. The trust deed for the Adnyamathanha Master Trust dated 22 July 2003 (Trust Deed) is amended such that item 2 of the Schedule to the Trust Deed is to read ‘10 May 2025’.
  2. Until further order, the Respondent is to provide notice to the special administrator of an intention to call a meeting to consider variations to the Trust Deed, at least one week before notice of the meeting is given.
  3. The matter is adjourned to 9:15 am on Monday 12 August 2024 for directions.


The first order above means the Adnyamathanha Master Trust will stay active until 10 May 2025.  There will be another hearing with the Chief Justice on 12 August 2024.

Please note we continue to wait for the South Australian Appeals Court to hand down its decision on the appeal.  We must wait for this outcome to be provided before taking any further steps in the Court.
