CONFIDENTIALITY DEED - Heathgate and Quasar NTMAs

To receive a copy of the Heathgate / Quasar NTMA and any other information provided by ATLA about the agreement (the Documents), you agree that:

  1. The Documents are confidential.
  2. You will not share the Documents, or information in the Documents, to anyone that is not an Adnyamathanha Common Law Holder or ATLA representative unless you:
    1. receive written consent from ATLA and Heathgate and Quasar.
    2. are legally required to share the Documents.
    3. need to share the Documents to enforce or get advice about your rights under the Heathgate NTMA and under the Quasar NTMA.

  1. are the descendants (whether biologically or by adoption) of the following apical ancestors:

    1. Mt Serle Bob
    2. Polly, wife of Mt Serle Bob
    3. Quartpot Tommy
    4. Mt Serle Bob’s sister, wife of Quartpot Tommy
    5. Willy Austin Snr
    6. Nicholas Demell
    7. Emily McKenzie, wife of Nicholas Demell
    8. Sydney Ryan
    9. Mary, wife of Sydney Ryan
    10. the siblings Angepena Billy or Mary
    11. Fanny, wife of Angepena Billy
    12. the siblings Sara Johnson, Matilda Johnson, Fred Johnson, Natalie Johnson, Jessie Johnson or Sydney Jackson

  2. identify as Adnyamathanha; and
  3. are recognised by other Common Law Holders under the relevant Adnyamathanha traditional laws and customs as having maintained an affiliation with, and continuing to hold common law rights and interests in, the Determination Area.
